Q2: What types of national real estate cannot be exchanged?

A2:

According to Article 7 of the "Regulations for Exchange between National Non-public Use Real Estate and Other Real Estate,” national real estate in one of the following circumstances shall not be exchanged for real estate owned by others:

I. Public facilities use land

II. National real estate over which other rights have been created, except those with the consent of other rights holders

III. Leased national real estate, except that with the consent of the lessee

IV. National real estate used to offset taxes, except that the real estate acquired after the exchange is easier to realize

V. National real estate that has been occupied, except that the applicant promises to handle the problem by himself/herself
