Q8:What are the restrictions on the use of non-public-use national property for outsourcing?

A8:     The use of non-public-use national property for outsourcing should be restricted with reference to the zoning control of urban planning land and the use control of non-urban planning land. Outsourcing contractors must not use such property illegally. In addition, the restrictions on different uses are as follows:

1.       Provision for use as determined by the competent authority of the target business

(1)  Uses required for provision as determined by the competent authority of the target business

(2) Restrictions on use

1)  Zoning of construction sites of all buildings.

2)  Facilities in relation to residences and residential communities.

3)  Sand and gravel excavation.

4)  Facilities in relation to waste disposal (including the recycling, storage, disposal, processing, and landfill of waste and resources).

5)  Facilities in relation to funeral services

6)  Facilities in relation to the production, packing, and stacking of firecrackers and natural gases.

7)  Facilities in relation to earth stacking and disposal sites, sand and gravel stacking, storage and transportation, and aggregate plants. However, if the competent authority of the target business of the outsourcing property determines that the property is used as temporary facilities required by an important construction project, such restrictions will not apply when the competent authority supervises the property use and requests the outsourcing contractor to restore the property as is after use.

2.       Development, planning, or establishment made with the permission of the competent authority of the target business

(1)  Outsourcing contractors must use the property for the purpose of development, planning, or establishment as approved by the competent authority of the target business.

(2)  Restrictions on use

1)  Zoning of construction sites of all buildings.

2)  Facilities in relation to residences and residential communities.

3)  Sand and gravel excavation.

3.    The following uses of the property are not allowed when the term of outsourcing is less than one year.

(1)  Zoning of construction sites of all buildings.

(2)  Facilities in relation to residences and residential communities.

(3)  Sand and gravel excavation.

(4)  Facilities in relation to waste disposal (including the recycling, storage, disposal, processing, and landfill of waste and resources).

(5)  Facilities in relation to funeral services

(6)  Facilities in relation to the production, packing, and stacking of fireworks and natural gases.

(7)  Facilities in relation to earth stacking and disposal sites, earth stacking, storage and transportation sites, and aggregate plants.

(8)  Passages or private channels or waterways.
