Question1:How do agencies that manage national public use lands provide said lands to others for afforestation in response to climate change and in line with the national goal of net-zero transformation? And how to afforestors who plant forests on said lands obtain the “reduction credit” specified in Subparagraph 13, Article 3 of the Climate Change Response Act?

In accordance with Articles 11 and 32 of the National Property Act, national public use lands managed by agencies shall be managed and utilized by the management agencies in accordance with predetermined plans, stipulated purposes, or enterprise purposes. If it is intended to be provided to others for afforestation use and the afforestor obtains the “reduction credit,” unless otherwise specified by other laws, the management agency may lease it out in accordance with the “Revenue Directions for National Public Real Estate” established by the Ministry of Finance, under the proviso of Article 28 of the National Property Act and Article 25 of the Regulations for the Enforcement of National Property Act. Leasing methods include direct leasing (the management agency may lease to specific parties to meet the needs of business, public works or public utilities of government agencies, including management agencies) and open tender for leasing (the tendering and awarding procedures shall refer to the relevant provisions of the Government Procurement Act). Relevant income, unless otherwise provided by other acts, shall be paid to the National Treasury in accordance with Article 7 of the National Property Act.
