Standardization of Creation of Superficies for Leasing National Land Through Tendering (2010)

1. Given the government’s ongoing financial difficulty and inability to fulfill the increasing demand for infrastructure construction and social welfare, the public sector has gradually introduced private investments in related projects to make “public-private partnership (PPP)” a mainstream trend and a policy direction. The saying goes, “When there is property, there is wealth”. Property is not only an asset, but also an important resource of people. Therefore, making the best use of national land in the land supply and demand market has become one of the important issues that concerns both the government and the public.

2. The government has relaxed regulations to allow development on national land by tendering the right of superficies, extend the duration of superficies, and lower the standard for royalty and land rent calculation with greater flexibility to encourage private investments. However, does this reflect the supply and demand of the real estate market? In addition, what is the market acceptance of products with superficies but no land ownership? Hence, this study analyzes the position and product category of superficies for tendering created on national land and makes recommendations for the countermeasures and management mechanisms to be taken and developed by the government.

3. In addition, this study makes suggestions for the assessment indicators (including land screening and selection, duration, and the standard for calculating and charging royalties and rents) for creation of superficies on national land, hoping to help standardize the processes for creating superficies on national land for tendering, attract the active participation of investors, and effectively enhance the efficient use of national property.
