Q3:Does illegal occupation of national land constitute criminal liabilities?

A3:     In addition to the offense of occupying real property as specified in Article 320 of the Criminal Code, whose penalties include imprisonment for a maximum of five years, remand, or an administrative fine of a maximum of NT$500,000, offenders will need to vacate the occupied national land and return the undue enrichment as specified in Article 179 and Article 767 of the Civil Code. Furthermore, if the illegally occupied national land is located in the slope area degraded as a result of the occupant’s illegal use, this will constitute an offence of the Slopeland Conservation and Utilization Act and the Soil and Water Conservation Act. Citizens are strongly advised not to challenge the law.
