Q1:How is the compensation for the private occupation of national land calculated?

A1:     According to Article 179 of the Civil Code, “A person who acquires interests without any legal ground and prejudice to the other shall be bound to return it.” In addition, according to Paragraph 1 of Point 6 and Paragraph 1 of Point 7 of the “Disposal Direction for Occupied National Non-Public Use Real Estate Non-Public Use National Property” (“Handling Directions”), before the occupant acquires the sources of legal right to use of or vacates and returns the occupied property, a NPA branch or office should claim from the actual occupant the compensation for use of the occupied national real estates during the occupancy with the criteria for calculation of the compensation for use of the occupied national non-public real estates (see Point 7 of the Handling Directions) based on the actual condition of occupation.
