Q3: What types of real estate shall not be exchanged for national real estate?

A 3:

According to Article 8 of the "Regulations for Exchange between National Non-public Use Real Estate and Other Real Estate,” real estate owned by others in one of the following circumstances shall not be exchanged for national real estate:

I. Public facilities use land

II. Shared real estate, except that all the co-owners apply for exchange or are originally public-private owned

III. The real estate over which other rights have been created, except when other rights holders agree to cancel the other rights originally created when the exchange registration is conducted

IV. That which is leased or loaned out

V. That which has been occupied

VI. There are objects on the land, except that they are determined not to hinder the handling of real estate and their owner agrees to donate them to the government

VII. That which has a completed road or ditch
