Q4: When the lease term of the leased national land is about to expire, how can the lessee renew the lease?

A4:

The lessee intending to renew the lease shall apply to the leasing authority for renewal of the lease within three months before the lease expires (the lease term of site is about two years). Submit the following documents when applying:

I. The original lease agreement (if lost, the lessee or his/her statutory agent shall sign an affidavit stating that the lease agreement has been lost).

II. A photocopy of the lessee's identification (note that "this photocopy is consistent with the original, the registration information is still valid; if not, I am willing to take legal responsibility" and affix a seal).

III. Depending on the application type, submit the following documents:

(I) Site:

1. The constructional improvement on the site of which the first-time registration of ownership has been conducted: a photocopy of the ownership certificate or a registration transcription.

2. The constructional improvement on the site of which the first-time registration of ownership has not been conducted: the affidavit stating that the constructional improvement does belong to the lessee.

3. The affidavit stating that the lessee still uses the leased land as a building site.

(II) House:

1. An affidavit stating that the lessee is the user currently.

2. A photocopy of the current household registration certificate of the lessee whose household is registered in the house. However, if the lessee is not a natural person, a certificate issued by a government agency or public enterprise proving that the current lessee actually uses the house shall be submitted.

(III) Other land:

1. An affidavit stating that the lessee is the user currently.

2. If the leased land is located on slopeland, an affidavit stating that its area does not exceed the upper limit of the area specified in Article 20 of the Slopeland Conservation and Utilization Act shall be submitted.

3. Those who lease the land for afforestation shall submit an affidavit stating that the land shall be used for afforestation in the manner of forestry management.
