Q11: What shall happen if the lessee dies and the heir fails to arrange the change of the lease agreement of national land and the inheritance of leasehold right within six months?

A11:

During the existence of the lease relationship, if the lessee dies, the heir of the lessee shall apply for the inheritance of the lease relationship with a replacement lease agreement within 6 months from the date of inheritance. Violation of the above provisions will be dealt with in the following manner:

I. The leasing agency shall notify the heir of the lessee of afforestation land that he/she shall apply for the change of the lease agreement owing to succession within one month; if he/she fails to do this, the lease shall be terminated.

II. For lease agreements other than those mentioned in the previous paragraph, unless otherwise provided by law, the leasing agency shall notify the heir that he/she shall pay the overdue fine and apply for a change of the lease agreement owing to succession within one month; if they fail to do this, the lease shall be terminated. (The overdue fine of the amount of the monthly rent paid in the month the succession occurs shall be imposed for each month overdue, and the maximum penalty is the fine in the amount of five times the monthly rent).
