Settlement of occupied non-public-use national land

Based on the laws and regulations currently in effect, occupied non-public-use national land will be settled by means of lease, sales, tendering, appropriation, advice of self-demolition or return after vacation, and referral to the competent authority for direct demolition by law. However, litigation will be employed to end occupation when the occupant does not meet the lease or purchase requirements or refuses to lease or purchase such property.

Before the settlement of occupation of non-public-use national land, according to Article 179 of the Civil Code, “A person who acquires interests without any legal ground...shall be bound to return it.” After detecting new illegal occupation, we will refer the case to the police or directly file a suit to the court of law according to Article 320 of the Criminal Code.
