6. When a PV business applies for a green energy allowable use, can the letter of intent for the development issued by branches or offices of the NPA be used as a proof of consent for the use of the land?
  1.  No. The letter of intent for development issued by the branch offices of the NPA only provides the applicant with the opportunity to apply for the development of the land, and the applicant is not allowed to use the national land until he or she has obtained the legal right to use it. Therefore, the application for letter of consent for development issued by the branches or offices of the NPA is not a letter of consent for the use of the land.
  2.  According to the explanation made by the EA in the briefing on the promotion of the new system of multiple use for fishery and electricity symbiosis in the Ministry of Finance on April 8, 2022, in the cases of fishery and electricity symbiosis, in accordance with Article 3 of the Regulations on Registration of Electricity Industry, the farmer’s consent authentication should be provided when applying for the permit for the build application of the electricity enterprise. The Bureau has not formulated the format of the “farmer’s consent authentication”. When PV business adopts the new system of multiple use for fishery and electricity symbiosis, the format of the lessee’s consent form formulated by the National Property Administration may be used. And, in accordance with the Letter Nong-Yu-Zi No. 1100257383 of the Ministry of Agriculture, Executive Yuan, dated January 20, 2022, PV business for the multiple use for fishery and electricity symbiosis, in addition to the land use consent document issued by the land owner in accordance with the provisions of Article 4 of the Regulations for Examining the Application of Structured Farming Facilities on Agricultural Land, the fishermen (lessees) should also attach consent documents to PV business to set up ground-based green energy facilities, to ensure the operation and production of aquaculture and fisheries are as the premise, and can be combined with green energy for common development.
  3.  Therefore, to apply for the new system of multiple use for fishery and electricity symbiosis, the business must obtain the lessee’s consent document (the National Property Administration has formulated the form) to apply for permission for the establishment of the electricity industry. After the signing of the contract of consigned operation, the branch offices of the NPA will issue a letter of consent for the use of the land, in accordance with the contract of consigned operation, for the PV business to apply for green energy allowable use.
