5. Is there any difference in the way PV business handle fishery and electricity symbiosis whether the national land is leased for aqua (cultural) purposes?
  1.  If a PV business obtains a permission from the responsible authority to develop national non-public use land, they may apply for the consigned operations of such land in accordance with the provisions of Subparagraph 2, Paragraph 1, Article 5 of the “Implementation Directions for Consigned Operation Business of National Non-public Use Property”, subject to the scope of the national non-public use land which permits for development were obtained for.
  2.  If there are existing lease agreements for aqua (cultural) land within the national land which permits for development were obtained for, there are two ways for the business to establish fishery and electricity symbiosis: (1) under the new system of fishery and electricity symbiosis for the multiple use (that is, the two contractual relationships between leasing and consigned operations coexist); (2) after obtaining the lessee’s consent to renounce the lease, and the permit for the build application of the electricity enterprise, they can apply to the branches and offices of the National Property Administration to consign the operation of national land, engage in aquaculture on their own, or consign a third party to carry out aquaculture, and set up ground-based green energy facilities that combine with aquaculture operations. (That is, after the termination of the original lease, the business signs a contract of operation consignment, and acquires the land use rights of a single entity of the national land).
  3.  In the case of national non-public use land that is occupied or idle, applications for development are made in accordance with general photoelectric cases, and, upon approval, applications can be made for operation consignment. The business shall submit an affidavit to handle the aboveground buildings on their own before signing a contract for operation consignment. In accordance with the requirements of the responsible authorities, the business shall perform the aquaculture operation by themself, or consign the operation to others while maintaining the land and electrical facilities.
